This Privacy Policy explains how HomeSway LLC ("HomeSway," "we," "us," or "our") collects, uses, and shares information about you when you use the HomeSway website and services (the "Service"). We take your privacy seriously and aim to be transparent about our practices.

By creating an account, logging in, or using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Policy, you should not use the Service.

HomeSway is a real estate technology platform that allows property owners ("Sellers") to explore potential listing strategies and connect with licensed real estate professionals ("Agents"). We use third-party data and internal tools to provide estimates, insights, and matching features that help both sides make more informed decisions.

2. Information We Collect

The information we collect depends on how you use the Service and whether you use HomeSway as a Seller, an Agent, or both. We may collect the following categories of information:

2.1 Information you provide directly

  • Account information: name, email address, password or authentication credentials, and role (e.g., Seller or Agent).
  • Seller information: property address or approximate location, property characteristics (such as beds, baths, square footage, property type), proposed listing price, commission preferences, and other details you choose to provide.
  • Agent information: name, brokerage, license number (e.g., DRE number), years active, service areas, closed or active listings, biography, profile photos, and any videos or marketing materials you upload.
  • Communications: messages and other communications you send to us (for example, support requests) or that are transmitted via the Service between Sellers and Agents.

2.2 Information we collect automatically

When you use the Service, we and our service providers may automatically collect certain information about your device and usage, including:

  • Usage data: pages or screens you view, features you use, time spent on the Service, referring/exit pages, and dates and times of activity.
  • Device and log data: IP address, browser type, operating system, device identifiers, and error logs.
  • Cookies and similar technologies: small data files stored on your browser or device to help us remember your preferences, keep you signed in, and understand how the Service is used.

2.3 Information from third parties and public sources

We may receive information from third parties in connection with providing the Service, including:

  • Property data providers: third-party data sources (for example, AVM and public record providers similar to ATTOM) may provide property characteristics, sales history, valuation estimates, and related data.
  • Authentication and infrastructure providers: services such as Supabase that help us manage accounts, databases, and secure storage.
  • Analytics and security tools: services that help us understand usage patterns, detect abuse or bots, and protect the Service (including tools like bot detection or CAPTCHA services).

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Providing and maintaining the Service: creating and managing accounts, enabling Seller and Agent dashboards, and operating matching and messaging functionality.
  • Valuations and insights: generating fair market value estimates, days-on-market predictions, net proceeds calculations, and other analytics for Sellers and Agents.
  • Personalization: tailoring content, dashboards, and recommendations based on your role, preferences, and use of the Service.
  • Security and fraud prevention: protecting accounts, detecting suspicious or unauthorized activity, and enforcing our Terms & Conditions.
  • Communication: sending you transactional emails or messages (such as account alerts, security notifications, or updates about changes to the Service or this Policy).
  • Improvement and research: analyzing how the Service is used to improve features, performance, and user experience.
  • Legal and compliance: complying with applicable laws, regulations, and legal processes, and protecting the rights, property, and safety of HomeSway, our users, and others.

4. How We Share Information

We do not sell your personal information. We may share information about you as described below, or as otherwise disclosed at the time of collection:

4.1 With other users of the Service

  • For Sellers: Agents may see your approximate property location, deal terms (such as proposed price and commission structure), and certain property details when reviewing potential opportunities. Your exact address and direct contact information are only shared after you accept an Agent through the Service.
  • For Agents: Sellers may see your agent profile, including your name, brokerage, years active, service areas, profile photo, agent bio, and representative listings you choose to display.

4.2 With service providers

We may share information with third-party companies and individuals that help us operate, maintain, and improve the Service, such as:

  • Hosting and infrastructure providers (e.g., Vercel).
  • Authentication, database, and storage providers (e.g., Supabase).
  • Email and communication providers.
  • Analytics, monitoring, and security tools.

These service providers are permitted to use information about you only to perform services on our behalf and are subject to confidentiality obligations.

4.3 For legal reasons

We may disclose information about you if we believe in good faith that such disclosure is reasonably necessary to:

  • Comply with any applicable law, regulation, or legal process.
  • Respond to valid requests from law enforcement or government authorities.
  • Protect the rights, property, or safety of HomeSway, our users, or others.
  • Detect, prevent, or address fraud, security, or technical issues.

4.4 Business transfers

If we are involved in a merger, acquisition, financing, or sale of all or a portion of our business, information about you may be transferred as part of that transaction, subject to the terms of this Privacy Policy or a successor policy that provides substantially similar protections.

The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18 without appropriate consent, we will take steps to delete that information. If you believe that a child under 18 has provided us with personal information, please contact us at support@homesway.com.

9. Your Choices and Rights

Depending on where you live, you may have certain rights regarding your personal information, such as the right to access, correct, or delete information we hold about you, or to request that we restrict or object to certain processing.

You can also:

  • Update your account information by logging into your HomeSway account and editing your profile.
  • Opt out of non-essential emails by using the unsubscribe link in those emails, where applicable.
  • Request deletion of your account by contacting us at the email below. We may retain certain information as required by law or for legitimate business purposes.

If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and its amendments, including the right to know, delete, and non-discrimination for exercising your rights. HomeSway does not sell your personal information as that term is defined under the CCPA.

10. International Users

The Service is currently focused on U.S. real estate markets and is operated from the United States. If you access the Service from outside the United States, you understand that your information may be processed and stored in the United States and other countries where our service providers operate, which may have different data protection laws than your country of residence.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. If a change is material, we may provide additional notice (for example, by email or by a prominent notice in the Service). Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Policy.
